2. Requirements for a Valid DMCA Takedown Notice
To file a valid DMCA takedown notice under 17 U.S.C. § 512(c)(3), your written notice must include all of the following:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- Identification of the copyrighted work claimed to have been infringed (or a representative list if multiple works are covered by a single notification).
- Identification of the material that is claimed to be infringing or the subject of infringing activity, and information reasonably sufficient to permit us to locate the material on our website (e.g., the specific URL).
- Your contact information, including your name, address, telephone number, and email address.
- A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Incomplete notices may not be acted upon. We recommend consulting with legal counsel before submitting a DMCA notice.
3. Counter-Notification
If you believe that material you posted was removed or access to it was disabled as a result of a mistake or misidentification of the material, you may submit a counter-notification to our Copyright Agent. A valid counter-notification under 17 U.S.C. § 512(g)(3) must include:
- Your physical or electronic signature.
- Identification of the material that was removed or to which access was disabled, and the location at which the material appeared before it was removed or access to it was disabled (e.g., the specific URL).
- A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of a mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which Uni2Study.com may be found), and that you will accept service of process from the complainant.
Upon receipt of a valid counter-notification, we will forward it to the original complainant and may restore the removed content within 10–14 business days unless the complainant notifies us that they have filed a court action seeking to restrain you from engaging in the infringing activity.
4. Repeat Infringers
It is our policy to terminate the accounts or access of users who are repeat copyright infringers in appropriate circumstances and at our sole discretion.
5. Misrepresentation
Please be aware that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake or misidentification, may be subject to liability for damages, including costs and attorneys' fees incurred by the alleged infringer, by any copyright owner or copyright owner's authorized licensee, or by a service provider.
6. Safe Harbor
Uni2Study.com operates as an information aggregator and educational resource platform. We make good-faith efforts to respond to DMCA notices promptly and act as a qualifying service provider under 17 U.S.C. § 512 safe harbor provisions. We do not host user-generated uploads as a core service feature, but we acknowledge that third-party content may sometimes appear on our platform and we are committed to addressing legitimate claims without delay.
