Studying abroad before age 18 comes with a legal requirement many families do not expect: someone in the destination country must be formally responsible for your child's welfare, separate from the school itself. Requirements differ by country, and using the wrong document type can delay your child's visa or enrollment.

United Kingdom: the Child Student visa and guardianship

Students aged 4 to 17 who want to study at a UK independent school apply for the Child Student visa . The application requires the consent of a parent or legal guardian to study and live in the UK, an unconditional offer from the school, a suitable accommodation arrangement, and proof of enough funds to cover course fees and living costs. The visa application fee was £558 in 2026, plus the healthcare surcharge for the length of the visa.

Consent on the visa form is not the same as day to day guardianship. UK independent schools generally require every under-18 international student to have a UK-based guardian who can attend school meetings, arrange transport, handle emergencies and provide a home during school holidays. Most families arrange this through a guardianship organization rather than an individual family friend, since organizations carry ongoing accountability that an informal arrangement does not.

Australia: welfare and custody arrangements

Under the Department of Home Affairs student visa rules , an applicant under 18 must have adequate welfare arrangements in place before the visa is granted, unless they will turn 18 by the time they arrive. A person providing welfare must be a nominated parent, legal custodian or relative over 21 years old, and that person must hold a visa allowing them to stay in Australia for the full period the student is under 18.

If no eligible adult relative is available, the education provider can issue a Confirmation of Appropriate Accommodation and Welfare, known as a CAAW, taking on that welfare responsibility instead. Either way, the arrangement must cover the period from arrival until the student turns 18, or until seven days after the Confirmation of Enrolment ends, whichever comes first. The student cannot arrive in Australia before the welfare arrangement's stated start date.

New Zealand: the Pastoral Care Code

New Zealand's Education (Pastoral Care of Tertiary and International Learners) Code of Practice 2021 applies to every NZQA signatory institution enrolling international students. For learners under 18, the Code requires the provider to get written agreement from the parent or legal guardian on decisions affecting the student's accommodation, and to carry out safety checks on any residential accommodation provider before placing a student there.

The Code also requires providers to communicate effectively with parents or guardians throughout enrollment, not only at the point of placement. Ask a prospective school directly how it documents this agreement and how often it re-checks accommodation, since the Code sets the standard but leaves the specific process to each provider.

Choosing a guardian or guardianship organization

In the UK, check whether a guardianship organization holds accreditation from AEGIS, the Association for the Education and Guardianship of International Students. AEGIS inspects organizations against safeguarding and operational standards, and offers two tiers: a preliminary level for newer organizations and a gold standard level that requires the organization to have already cared for at least 3 students for two terms before it can apply. Ask to see the organization's current accreditation certificate rather than relying on a claim on their website.

Start the paperwork early

Guardianship and welfare arrangements sit on the critical path for the visa application in all three countries, since the visa cannot be granted without them for an applicant under 18. Begin arranging a guardian or confirming a CAAW as soon as your child has an offer, rather than waiting until you start the visa application itself, since accredited organizations and school placements can take weeks to confirm.

Keep copies of every guardianship or welfare document with you, with your child, and with the school, and update the paperwork immediately if your child changes address, school or guardian while still under 18. An arrangement that lapses partway through the year can affect visa conditions and, in Australia, breaches a condition of the student visa itself.
