Contract Terms and Refund Rights When Working With a Vietnamese Study Abroad Agent

TL;DR

Before paying a Vietnamese study abroad agent, get the fee schedule, the services covered, and the refund conditions in writing, including what happens if your visa is refused or your admission falls through. A verbal promise is not enforceable.

  • 📩 Insist on a written contract, never a verbal agreement or chat message

  • Get every fee itemized separately, not bundled into one lump sum

  • Confirm the refund terms for visa refusal and for admission rejection specifically

  • Check the cancellation terms before any service has started

  • Know where to file a complaint if the agent will not honor the contract

Contract Terms and Refund Rights When Working With a Vietnamese Study Abroad Agent

Why a written contract is your main protection

A study abroad agent's promises only protect you if they are written into a signed contract. Vietnamese consumer protection rules require service providers to give consumers clear, written contract terms and restrict unfair terms that one-sidedly favor the business.

A verbal assurance from a sales consultant carries no weight once a dispute starts, so treat every promise you were given verbally as void until it appears in the contract text.

What a fair contract itemizes

  • Every service included, listed separately: application handling, document translation, visa file preparation, pre-departure support

  • The exact fee for each service, not one bundled figure

  • Which payments are refundable and which are not, stage by stage

  • A named timeline for each stage of the process

  • Which party is responsible if a document error causes a delay or rejection

Refund conditions to confirm before paying

Ask specifically, in writing, what happens in each of these situations:

  • Your visa application is refused by the destination country's immigration authority

  • The university rejects your admission application

  • You change your mind before the agency has started any work

  • The agency misses a documented deadline and causes you to miss an intake

A contract that stays silent on any of these, or states that no refund applies under any circumstances, shifts every risk onto you.

Push for a staged refund schedule instead, where a deposit is retained for work already done but the remainder returns to you if the outcome was outside your control.

Payment staging protects you more than a discount does

Agencies sometimes offer a discount for paying the full package upfront. Paying in stages, tied to milestones such as document submission, offer letter receipt, and visa lodgement, protects you far more than any discount is worth, since it keeps your leverage intact if the agency underperforms at any stage.

If the agency will not honor the contract

Start by sending a written complaint to the agency itself, referencing the specific contract clause it has not honored, and keep a copy. If that does not resolve the issue, escalate a complaint to the provincial Department of Education and Training that issued the agency's operating certificate, or to Vietnam's national consumer protection authority, which handles disputes between consumers and businesses. Keep every receipt, message and signed document, since these form your evidence if the dispute proceeds to mediation or court.
